Annahita Moradi presented draft guide on existing international standards relating to immigration detention conditions before the Council of Europe

15 – 17 March 2023, Paris: Annahita presented her co-authored draft guide on existing international standards relating to the rules on the material conditions of immigration detention, before the Council’s European Committee on Legal Co-operation’s Working Group on Migration.

Annahita and her co-consultant addressed Member State representatives and committees including GRETA (Group of Experts on Action against Trafficking in Human Beings) and CPT (European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment) on key caselaw from the European Court of Human Rights (Articles 2 – 6, 9 and 14 of the Convention) and agreed international standards as they relate to detention conditions.

The purpose of the draft guide is to protect and promote the human rights of those detained under immigration powers in the jurisdictions of all 46 Member States, and to provide guidance to their national authorities and those working with persons held on these critical legal issues. The guide is being finalised by the Working Group for adoption by the European Committee on Legal Co-operation, possibly in June 2023.
