Despite the young person’s vulnerabilities (ADHD, ASD), the court considered that the young person was able to recognise the risks and take measures to attempt to keep himself safe.
The Court considered that it would be inappropriate and disproportionate to invoke the Court’s inherent jurisdiction in light of the young person’s opposition to being detained in a secure environment.
